Federal Court Blocks Biden Asylum Ban

A federal court today blocked the Biden administration’s new asylum ban, but delayed its ruling from taking effect for 14 days. 

The plaintiffs — East Bay Sanctuary Covenant, American Gateways, Central American Resource Center, Immigrant Defenders Law Center, National Center for Lesbian Rights, and the Tahirih Justice Center — are represented by the American Civil Liberties Union, ACLU of Northern California, Center for Gender & Refugee Studies, and National Immigrant Justice Center.

The parties were in court on July 19 for arguments in their lawsuit, East Bay Sanctuary Covenant v. Biden, filed in May when the Biden administration implemented the new asylum restrictions that mimic two past policies — the “entry” and “transit” bans — which were struck down by the courts under the Trump administration. 

Judge Jon Tigar of the U.S. District Court of the Northern District of California heard the arguments.

The government previously indicated that it may ask the Ninth Circuit Court of Appeals for further relief from the ruling.

“The ruling is a victory, but each day the Biden administration prolongs the fight over its illegal ban, many people fleeing persecution and seeking safe harbor for their families are instead left in grave danger,” said Katrina Eiland, deputy director of the ACLU’s Immigrants’ Rights Project, who argued the case. “The promise of America is to serve as a beacon of freedom and hope, and the administration can and should do better to fulfill this promise, rather than perpetuate cruel and ineffective policies that betray it.”

Melissa Crow, director of litigation at the Center for Gender & Refugee Studies, said, “The court got it right. President Biden’s asylum ban violates our laws and makes a mockery of our asylum system. Last week the government conceded that under the ban, people with meritorious legal claims can be barred from asylum and deported to countries where they face grave harm. To them, that is an acceptable price to pay for the illusion of border management. But they are breaking the law, sowing chaos, and putting vulnerable people in harm’s way. We urge the administration to stop defending this illegal policy, and instead take immediate steps to establish a fair and humane process that upholds the rights of all people seeking refuge at our nation’s doorstep.”

Keren Zwick, director of litigation at the National Immigrant Justice Center, said, “The court’s ruling is welcome and expected, since the new policy simply rehashed prior rules that restricted access to asylum based on similar grounds, which courts already rejected. U.S. laws protect the rights of people fleeing persecution to come to this country and pursue asylum, full stop. We encourage the Biden administration to now direct its resources to upholding that right, rather than fighting to continue this unlawful and inhumane asylum ban.”

Corte federal bloquea Prohibición de Asilo de Biden

Una corte federal bloqueó hoy la nueva prohibición de asilo de la administración de Biden, pero suspendió la aplicación de su decisión durante 14 días.

Los demandantes — East Bay Sanctuary Covenant, American Gateways, Central American Resource Center, Immigrant Defenders Law Center, National Center for Lesbian Rights, y Tahirih Justice Center —  son representados por American Civil Liberties Union, ACLU del Norte de California, Center for Gender & Refugee Studies, and National Immigrant Justice Center.

Las partes comparecieron ante el tribunal el 19 de julio para presentar argumentos en la demanda East Bay Sanctuary Covenant v. Biden. Los demandantes instauraron la demanda en mayo cuando la administración de Biden implementó las nuevas restricciones de asilo. Estas nuevas restricciones  imitan dos políticas pasadas, las prohibiciones al asilo por  “entrada" y "tránsito", las cuales los tribunales declararon ilegales  durante los años de la administración de Trump.

El juez Jon Tigar de la Corte de Distrito de EE. UU. para el Distrito Norte de California escuchó los argumentos.

El gobierno indicó con anterioridad que apelaría la decisión ante la Corte  de Apelaciones del Noveno Circuito. 

"La decisión es una victoria, pero cada día que la administración de Biden extiende la lucha por su prohibición ilegal, muchas personas que huyen de la persecución y buscan refugio para sus familias quedan expuestos a graves graves peligros", dijo Katrina Eiland, directora adjunta del ACLU’s Immigrants’ Rights Project, quien argumentó el caso. "La promesa de Estados Unidos es servir como un faro de libertad y esperanza, y la administración puede y debe hacer más para cumplir esta promesa, en lugar de perpetuar políticas crueles e ineficaces que la traicionan".

Melissa Crow, directora de litigios del Center for Gender & Refugee Studies, dijo: "La corte tomó la decisión correcta. La prohibición de asilo del presidente Biden viola nuestras leyes y ridiculiza nuestro sistema de asilo. La semana pasada, el gobierno admitió que, bajo la prohibición, se le puede negar protección a personas con casos de asilo válidos y deportar las a países donde enfrentan graves peligros. Para ellos, eso es un precio aceptable a pagar por la ilusión de control fronterizo. Pero están violando la ley, sembrando el caos y poniendo a personas vulnerables en peligro. Instamos a la administración a que deje de defender esta política ilegal y, en cambio, tome medidas inmediatas para establecer un proceso justo y humano que proteja los derechos de todas las personas que buscan refugio en la puerta de nuestra nación".

Keren Zwick, directora de litigios del National Immigrant Justice Center, dijo: "La decisión del tribunal es bienvenida y esperada. La nueva política simplemente revive versiones anteriores que los tribunales declararon ilegales por buscar restringir el acceso al asilo utilizando fundamentos similares. Las leyes de EE. UU. permiten que las personas que huyen de la persecución puedan venir a este país a solicitar asilo, y punto. Alentamos a la administración de Biden a que dirija ahora sus recursos a defender la ley, en lugar de luchar por mantener esta prohibición de asilo ilegal e inhumana".
