Today the Ninth Circuit Court of Appeals blocked the Trump Administration’s dangerous Migrant Protection Protocols (MPP), the policy which forcibly returns asylum seekers to Mexico to await their immigration court dates in perilous conditions.
The Center for Gender & Refugee Studies (CGRS), American Civil Liberties Union, and Southern Poverty Law Center challenged the policy last February after the Trump Administration launched MPP in early 2019. We won a preliminary injunction in April, which was stayed by the Ninth Circuit pending resolution of the Administration’s appeal, allowing MPP to remain in effect.
In the months since, nearly 60,000 asylum seekers have been left stranded in Mexico, where they have faced grave human rights abuses. Human Rights First has documented over 1,000 public reports of murder, torture, rape, kidnapping, and other violent attacks against asylum seekers and migrants returned under MPP, a figure that represents only the tip of the iceberg.
The court’s decision today restores the injunction and immediately halts the policy.
“We commend the court for finally putting an end to this unlawful and inhumane policy,” CGRS Legal Director Blaine Bookey said today. “Although the ruling cannot repair the profound pain and suffering that MPP has caused over this last year, we are hopeful the United States can once again stand as a safe haven for the persecuted.”
The lawsuit, Innovation Law Lab v. Wolf, was brought on behalf of 11 individual asylum seekers who were forced to return to Mexico under MPP, and organizational plaintiffs Innovation Law Lab, the Central American Resource Center of Northern California, Centro Legal de la Raza, the University of San Francisco School of Law Immigration and Deportation Defense Clinic, Al Otro Lado, and the Tahirih Justice Center.

Noveno Circuito detiene la política de retorno forzado a México del gobierno Trump
(Viernes, 28 de febrero de 2020) - El día de hoy la Corte de Apelaciones del Noveno Circuito bloqueó la peligrosa política Protocolo de Protección de Migrantes (o MPP, por sus siglas en inglés) del gobierno Trump, la cual obliga a solicitantes de asilo a regresar a México mientras esperan, bajo condiciones peligrosas, sus fechas para asistir a corte de inmigración.
El Centro de Estudios de Género y Refugiados (o CGRS por sus siglas en inglés), la American Civil Liberties Union y el Southern Poverty Law Center presentaron una demanda en contra de la política el pasado febrero luego de que la administración Trump empezara a implementar MPP a comienzos de 2019. En abril de 2019 ganamos una orden preliminar, la cual fue suspendida por el Noveno Circuito mientras se resolvía la apelación del gobierno, lo que permitió la continuación en la implementación de MPP.
En los meses que siguieron, alrededor de 60,000 solicitantes de asilo han sido regresados a México, donde han enfrentado serios abusos a sus derechos humanos. Human Rights First ha documentado más de 1,000 reportes públicos de homicidios, tortura, violaciones, secuestros, y otros ataques violentos en contra de solicitantes de asilo y migrantes retornados bajo MPP, cifra que solo representa la punta del iceberg.
La decisión de la corte hoy restaura la orden preliminar y detiene la política de manera inmediata.
“Elogiamos a la corte por ponerle un fin a esta política ilegal e inhumana”, dijo hoy la Directora Legal de CGRS, Blaine Bookey. “Si bien esta decisión no puede reparar el profundo dolor y sufrimiento que MPP ha causado a lo largo del ultimo año, tenemos la esperanza que Estados Unidos se erija otra vez como un refugio para los perseguidos”.
La demanda, Innovation Law Lab contra Wolf, fue presentada en representación de 11 solicitantes de asilo que fueron forzados a regresar a México bajo MPP, y las siguientes organizaciones: Innovation Law Lab, Central American Resource Center of Northern California, Centro Legal de la Raza, Immigration and Deportation Defense Clinic de la Escuela de Leyes de la Universidad de San Francisco, Al Otro Lado, y Tahirih Justice Center.
